Subpoenas
In order to issue a subpoena, you will need the following items:
- Payment of $2.00 payable to Orange County Clerk of Courts.

Prepared subpoena for clerk to add signature and seal.

One of the following if available: Notice of Trial, Notice of Taking Deposition with Parties Name, Date and Time, Notice of Deposition Duces Tecum (for taking records)
If you are using the Orange County Sheriff's Office to serve the subpoena, you will also need the following:
- Payment for $40.00 payable to Orange County Sheriff's Office for service per person.

Self-addressed stamped envelope for the return of service from the Sheriff's Office, mailed to:

In order to issue a subpoena for deposition from another state, the out-of-state attorney must provide:
- Notice of Taking Deposition with the name of the deponent, the scheduled date and time of deposition.
- Subpoena from another state already prepared with an area for the Orange County Clerk of Courts to sign and seal.
In order to issue a subpoena for records pick up or production from non-party, or subpoena duces tecum, the out-of-state attorney must provide:
- Notice of Records Pickup or Notice of Production from Non-Party with the date and time for records to be produced
- Subpoena from another state already prepared with an area for the Orange County Clerk of Courts to sign and seal
Note: Both the Notice and Subpoena must reflect the same date and time. This applies for both types of subpoenas.
If you are using the Orange County Sheriff's Office to serve the subpoena, you will also need the following:
- Payment for $55.00 payable to Orange County Sheriff's Office for service per person
- Self-addressed stamped envelope for the return of service from the Sheriff's Office, mailed to:

Our office no longer prepares subpoenas. There is a $2.00 charge for the issuance of the subpoenas. You will also need to provide self-addressed stamped envelopes as needed for return mailing whether it is going to the Sheriff or back to you.
These subpoenas can be mailed into our office or processed at the front counter in Room 350.
