CAP - Clerk's Assistance Program
CAP stands for Clerk's Assistance Program. CAP allows an individual
to obtain a valid driver's license while making payments on outstanding
traffic citations.
Who is eligible for CAP?
Individuals with a suspended driver's license for failure to pay
fines related to Orange County citations ONLY.

Who is not eligible for CAP?
Individuals with a suspended driver's license due to:
- An active DHSMV imposed suspension, or revocation
- An Active Court Collection Writ of Bodily Attachment
- Outstanding citations in other counties, states, or countries
- Uncompleted conditions, or requirements
- A current alcohol, or drug related revocation
- Unpaid child support
There may be other payment plans that you can apply for even if
you do not qualify for this program. Call for added information.
What does it cost to enroll in CAP?
A nonrefundable $5.00 research fee must be paid when your application
is submitted to the clerk. If accepted into the program a $50
fee
payment must be made within 15 days of the application and prior
to being approved. A Financial Counselor will notify you within
30 days after submitting the applications. Each case on the payment
plan will be assessed an administrative fee. The fee(s) will be
added into the toal amound due.

How soon will I be able to legally drive after
I enroll in CAP?
Immediately, in most instances the Clerk will reinstate the individual's
Driver's License upon receipt of the $47.50 reinstatement fee
and
a signed Notice of Fines and Costs. If the Clerk is unable to reinstate
the driving privilege, the Financial Counselor will provide a
letter
of D6 Satisfaction to be taken to the DHSMV for reinstatement.

What will be the amount of the payments
and how many payments will there be?
Your payment plan will be based upon the total remaining balance
due. Payments must be made on a monthly basis and the first
payment will be scheduled 30-40 days from the date you signed the
agreement.

What happens if I miss a payment or my payment
is late?
Driving privileges will be suspended if a payment is not made by
the date indicated on the schedule. A delinquency fee will be added
to each citation that has not been paid in full. In some instances
cases must comply with Collection Court policies and may require
a court appearance.

Must I have insurance?
Individuals who own a vehicle must provide proof of Personal Injury
Protection (PIP) insurance. Individuals who do not own a vehicle
must sign an affidavit.

a CAP clerk. After hours and weekends, please leave a message.
An application can be picked up at the information counter of any
of the Clerk of the Court offices listed below. You must submit
the application and $5.00 (nonrefundable) fee to the cashier at
any of the locations.
